Vinoth Kumar, Government Advocate (Criminal side) ORDER The petitioner, who was arrested under a P.T. warrant and remanded to judicial custody on 09.05.2025 for the alleged offences under Sections 331(3) and 305 of B.N.S. in Cr. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is under incarceration since 09.05.2025 and the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioner. 3. The learned Government Advocate (Criminal side) appearing for the respondent police strongly opposed to enlarge the petitioner on bail on the ground that there are 51 previous cases against this petitioner and he has been remanded into judicial custody in this case with great difficulty on execution of non-bailable warrant and hence if bail is granted to him, there is every possibility of absconding. 4. I have given anxious consideration to the submissions made by the learned counsel on either side. 5. The learned Government Advocate strongly opposed to enlarge the petitioner on bail on the ground that non-bailable warrant was issued against this petitioner in different different cases and that they were able to secure the petitioner with great difficulty and only after securing him, two cases are now completed. Though in those two cases, the petitioner was acquitted, the fact https://www.mhc.tn.gov.in/judis CRL OP No. 7416 of 2026 __________ Page3 of 4 remains that only because of his non-co-operative attitude, the trial could not be proceeded and there are 51 previous cases pending against the petitioner. In view of such factual position, this Court is of the firm view that as rightly contended by the learned Government Advocate, if the petitioner is enlarged on bail, there is every possibility of further delay in progress of the long pending criminal cases. Therefore, this Court is not inclined to enlarge the petitioner on bail at this stage. 6. Accordingly, this Criminal Original Petition is dismissed. 24-03-2026 MJS Note: 1.
