In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Hare Street P.S case no. 62 of 2026 dated 25/03/2026 under Sections 336/338/340(2)/61(2)/3(5) of the BNS. In the matter of: Simran Singh & Ors. ...Petitioners. Mr. Rajdeep Mazumder Mr. Mayukh Mukherjee Ms. Sagnika Banerjee …for the petitioners. Mr. Rudradipta Nandy Ms. Kanchan Roy …for the State.
1. Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the daughter and the sons of a co-accused who was granted anticipatory bail by this Court on 31/03/2026 in CRM (A) 1026 of
2026. There is an existing property dispute between the petitioners and the de-facto complainant. In any event, the prime allegations of the de-facto complainant are against the father of the petitioners.
2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statements of witnesses and other documents present in the case diary.
3. Considering the above, the other materials available in the case diary and the fact that the principal accused was granted anticipatory bail by this Court earlier, I do not
2
think that custodial interrogation of the petitioners is required in this case and I am inclined to grant anticipatory bail to the petitioners.
4. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner no. 2 shall meet the I.O once a fortnight till submission of report in final form. The petitioner no. 3 shall meet the I.O as and when required.
5. Accordingly, the application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
