1. Affidavit-of-service filed on behalf of the petitioners is taken on record.
2. Learned advocate representing the petitioners submits that on sanction of fund in their favour under Banglar Awaas Yojana petitioners tried to make construction on a particular land which was objected by the private respondents.
3. Petitioners pray for direction upon the concerned police authorities which would facilitate them to make construction.
4. Learned advocates representing the Private respondents and State respondents have jointly opposed this writ petition by making submissions.
5. It is contended on behalf of the private respondents that the land on which petitioners are trying to make construction belongs to the private
respondents.
6. In view of the respective submissions made on behalf of the parties, it is found that the issue involved in this writ petition is civil in nature requiring the petitioners to approach civil court in pursuit of remedy.
7. Police authority is not the appropriate authority to decide the right of the petitioners over the land in question.
8. However, concerned police authorities are directed to maintain peace and tranquility at the locale.
9. The writ petition stands disposed of.
10. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.) 2
