01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Balugaon P.S. Case No.20 of 2026 corresponding to G.R. Case No.31 of 2026 pending in the court of learned J.M.F.C., Chilika on the grounds stated. 3. Perused the FIR as at Annexure-1. The alleged mischief committed by the petitioner has been narrated in the report dated 13th January, 2026. It has been revealed from Annexure-1 that the petitioner demanded refund of money from the informant’s father and thereafter, did the mischief. It has been made to reveal from the report that the petitioner injured the informant’s father. Learned counsel for the petitioner submits that no serious injury has been received by the victim. Recorded the objection of the State. The Court finds that the petitioner committed the excess and the overt acts when the informant’s father declined to have received any money from
him. As it appears, the petitioner lost his mental balance and committed the overt act and even disrobed himself in presence of informant. Considering the above facts and the claim that he has no similar antecedent, recording the objection of the State, this Court though not inclined to grant him pre-arrest bail but is of the view that he should surrender before the learned court below for being released with stringent conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C., Chilika within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with G.R. Case No.31 of 2026 on furnishing a bail bond of Rs.25,000/- (rupees twenty-five thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not commit any other mischief involving the informant and stay away from her, while on bail and to report the I.O. once in a fortnight for the purpose of investigation and to continue to do so, till it is concluded. 6. Issue urgent certified copy of this order as per rules.
