Crl.M.P.(MD)Nos.3336, 3338, 3356, 3480, 3481, 3602, 3860, 3873, 3966, 3968, 3986 and 4107 of 2026 COMMON ORDER These petitions are filed to condone the delay of 520, 594 and 598 days in preferring the above criminal appeals, against the Judgment dated 25.04.2024 in Special Case No.91 of 2011 on the file of the learned Special Judge for Trial of Cases under Prevention of Corruption Act, Tiruchirappalli, in Crime No.6 of 2001 on the file of the respondent Police. 2.
2. The petitioners herein are purchasers of lands from accused Nos.1 and 2 in Special Case No.91 of 2011. The accused No.1, a Sub Registrar, along with his wife, purchased 61 acres of land at Kodaikanal. The Vigilance and Anti-Corruption Department registered a case as against the Sub Registrar and his wife that they have amassed wealth disproportionate to his known source of income. After the investigation, the final report was also filed before the learned Special Judge for Trial of Cases under Prevention of Corruption Act, Tiruchirappalli and it was taken on file in Special Case No.91 of 2011. The trial Court, by its Judgment dated 25.04.2024, found the accused Nos.1 and 2 guilty, convicted and sentenced them to undergo five years rigorous imprisonment and to pay a fine of Rs.10,000/-, in default, to undergo six months simple 13/17 https://www.mhc.tn.gov.in/judis
Crl.M.P.(MD)Nos.3336, 3338, 3356, 3480, 3481, 3602, 3860, 3873, 3966, 3968, 3986 and 4107 of 2026 imprisonment and also ordered for attachment of subject crime properties amassed by accused Nos.1 and 2. 3. Pending trial, the accused Nos.1 and 2 have created documents and sold away the properties to various persons. A portion of the properties were sold prior to the registration of FIR and some of the properties were also sold subsequent to the Judgment of the trial Court. The trial Court, while convicting the accused, has also ordered for attachment of properties of the accused Nos.1 and 2. The petitioners, who are in possession of those properties, have filed the appeals as against the order of attachment of properties passed by the trial Court dated 25.04.2024, however, with the delay of 520, 594 and 598 days. 4. The learned Government Advocate (Crl. Side) raised serious objection that all the petitioners, knowing the fact that the properties are the subject matters of the criminal case in Special Case No.91 of 2011, have purchased the properties at an undervalued price. According to him, the order of confiscation of properties dated 25.04.2024 was duly communicated to the Sub Registrar and also to the Inspector General of Registration on 29.04.2024. Crl.M.P.(MD)Nos.3336, 3338, 3356, 3480, 3481, 3602, 3860, 3873, 3966, 3968, 3986 and 4107 of 2026 03.02.2025 and M/s.Anitha Texcot (India) Private Limited has also purchased a portion of the properties on 06.09.2024.
Therefore, according to him, the petitioners have purchased the properties at an undervalued price, knowing that the subject properties are crime properties procured disproportionately to the income of the accused 1 and 2. 5. This Court considered the rival submissions made. 6. Admittedly, the petitioners are subsequent purchasers of the properties from accused 1 and 2 and they have purchased the properties prior to the registration of FIR and also during the trial. Admittedly, they are not the parties to the proceedings in Special Case No.91 of 2011, which was tried by the learned Special Judge for Trial of Cases under Prevention of Corruption Act, Tiruchirappalli. Since the properties stand in the name of accused 1 and 2, the trial Court, without providing an opportunity to the petitioners, who are the subsequent purchasers, has passed the order of confiscation. 7. It is also brought to the knowledge of this Court that the persons, who are similarly affected by the order of confiscation dated 25.04.2024 in Special 15/17 https://www.mhc.tn.gov.in/judis
Crl.M.P.(MD)Nos.3336, 3338, 3356, 3480, 3481, 3602, 3860, 3873, 3966, 3968, 3986 and 4107 of 2026 Case No.91 of 2011, have filed similar appeals before this Court as against the
order of confiscation dated 25.04.2024, in Crl.A.(MD)No.869 of 2025 and Crl.A.(MD)Nos.994 to 1019 and 1076 of 2025 and the same were allowed by this Court on 14.08.2025 and 30.10.2025, by remanding the matters for fresh
consideration by the trial Court.

Since the petitioners were not parties to the proceedings in Special Case No.91 of 2011 and they were affected by the order of confiscation dated 25.04.2024 passed by the trial Court and also in view of the earlier Judgments of this Court in Crl.A.(MD)No.869 of 2025 and Crl.A.(MD)Nos.994 to 1019 and 1076 of 2025, all the petitions are allowed and delay is condoned.
