Shukla, Advocate ---- 02/18.02.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Barhait P.S. Case No.172 of 2025 arising out of Complaint Case No.406 of 2021 for the alleged offences registered under Sections 493, 312, 376, 511, 323 and 34 of Indian Penal Code, pending in the Court of learned Sub-divisional Judicial Magistrate, Sahibganj. 3. Learned counsel appearing for the petitioner submits that falsely the petitioner has been implicated in this case and the allegations are made that on the pretext of marriage the petitioner has established relationship. He further submits that informant was voluntarily residing in the house of the petitioner and she is also a major lady. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of establishing 2026:JHHC:4815 --2-- A.B.A. No. 912 of 2026 relationship on the pretext of marriage. 5. From the FIR it transpires that the said relationship was already established in the year 2016 wherein the complaint case has been lodged on 25.08.2021 and it was converted into FIR on 04.11.2025 and from the contents of the FIR it has also been clear that both were residing together with consent of family members and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
