This is the Second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 1355/2021 registered at Police Station – Sarkanda District Bilaspur (C.G.), for the offence punishable under Sections 294, 323, 506, 307 & 34 of the IPC and Section 25 and 27 of the Arms Act. 2. The earlier bail application of the applicant has been rejected on merits VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.04.27 17:48:58 +0530 2 vide order dated 19.01.2022 passed in MCRC No. 9411 of 2021. 3. The prosecution story in brief, is that, the victim has lodged the F.I.R. Against the present applicant over a dispute of raising boundary wall on 18.10.2021, the applicant along with co-accused started abusing to victims and therefore the co accused Arjun Sahu came with the sword and assaulted them, whereby they sustained injuries on different pert of the body, on such complaint police has registered the case against the present applicant and started the investigation, and meanwhile arrested to the applicant. 4. Learned counsel for the applicant would submit that this is Second Bail application, the first bail application of the applicant was dismissed on merits. He further submits there is no recovery was made from the applicant and only a knife was recovered from his possession. the present applicant was earlier granted regular bail by the co-ordinate bench of this Court on 19.01.2022. Thereafter, the applicant failed to appear before the trial Court on the dates fixed for his appearance, and consequently, an arrest warrant was issued against him Eventually, the applicant was arrested on 09.09.2025, therefore, he prays for grant of regular bail to the applicant. 5. On the other hand, learned State counsel would oppose the prayer for grant of regular bail to the applicant. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, particularly that the present applicant was earlier granted regular bail by a co-ordinate Bench of this Court on 19.01.2025 and thereafter failed to appear 3 before the trial Court on the dates fixed for his appearance, resulting in the issuance of an arrest warrant and his subsequent arrest on 09.09.2025, and further considering that the case is at the verge of completion with only one prosecution witness yet to be examined, I am of the considered opinion that the applicant is not entitled to the grant of bail. 8. Accordingly, the second bail application of the applicant – Yashpal Sahu, involved in Crime No. 1355/2021 registered at Police Station – Sarkanda District Bilaspur (C.G.), for the offence punishable under Sections 294, 323, 506, 307 & 34 of the IPC and Section 25 and 27 of the Arms Act, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10.
