This writ petition has been filed, inter alia, praying for a direction upon the Municipal authority to provide a separate water connection to the petitioners’ premises situated at Khatian No. 204, Touzi No. 343, J.L. No. 43, Ward No. 33, Holding No. 54/120, Jele Para Road of Mouza- Nungi, under police station – Maheshtala. 3. The petitioners claim to be occupants in respect of the aforesaid property. Record would reveal that a partition suit is pending between the private parties being TS No. 328 of 2021 before the learned 7thCivil Judge (Senior Division) at Alipore. 4. Having regard thereto and upon hearing the submissions of the parties, I am of the view, at this stage that since a partition suit is pending, it shall not be appropriate for this Court to direct the Municipal authority to provide the petitioners with a separate water connection in holding in question, as 2 the same might give rise to multiplicity of judicial proceedings and when a civil dispute is under consideration before a civil court. 5. Accordingly, WPA 4159 of 2026 stands disposed of. (Raja BasuChowdhury, J)
