Sahoo, AGA CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 27.01.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Jankia P.S. Case No.544 of 2025 corresponding to G.R. Case No.1105 of 2025 pending in the court of learned J.M.F.C. (Cog.), Khordha on the grounds stated. 3. Perused the F.I.R. as at Annexure-1. The report reveals that the petitioner allegedly responsible for the ill-treatment and mischief committed. The informant, namely, mother-in-law lodged the FIR i.e. Annexure-1. Recorded the objection of the State. From the FIR as at Annexure-1, the Court finds that the petitioner assaulted the victim-wife. The Court further finds that due to the assault the victim suffered a facture injury as has been alleged by her in the FIR. Considering the above facts and submissions of learned counsel for the respective parties and since the parties are married for quite some time, this Court, though, not inclined to grant pre-arrest bail to the petitioner but is of the view that he should be directed to surrender before the learned court below and released on bail with stringent conditions imposed and subject to verification and absence of any such grievous injury caused to the victim wife. 4. Aaccordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C. (Cog.), Khordha within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with G.R. Case No.1105 of 2025 upon furnishing a bail bond of Rs.30,000/- (rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances and upon satisfaction arrived at that no serious injury has been received by the victim. 6.
