Affidavit of service filed on behalf of the petitioner is taken on record. No one appears on behalf of the de facto complainant.
Learned counsel appearing on behalf of the petitioner submits that his client has been falsely implicated in this case.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statement of the 14 year old victim recorded before the learned Magistrate clearly implicating the 68 year old petitioner. He also refers to the statements of other witnesses including an immediate post-occurrence witness present at page 33 of the case dairy. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner. The application for anticipatory bail of the petitioner is, thus, rejected.
