This writ petition is filed under Article 226 of the Constitution of India, claiming the following direction: “to issue a writ or order of direction more particularly one in the nature of Writ of Mandamus declaring the actions of respondents in demanding Additional Consumption Deposit from the petitioner by letter Lr No SE /0 /ATP /SAO /JAO HT /ACD / D No 940/15 dated 31 05 2015 issued by the 2nd respondent as highly illegal arbitrary unjust and contrary to Section 475 of the Electricity Act 2003 and consequently set aside the same” 2. Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents. 3. The case of the petitioner is that the 2nd respondents, vide Letter No.SE/O/ATP/SAO/JAO-HT/ACD/D.No.940/15, dated 31.05.2015, demanded an Additional Consumption Deposit (ACD) from the petitioner, which is alleged to be highly illegal, arbitrary, unjust and contrary to the Section 47(5) of the Electricity Act, 2003. Aggrieved by the said demand, the present Writ Petition is filed. 4. On the other hand, learned Standing Counsel appearing for the respondents has placed on record the Written Instructions submitted by the 3rd respondent herein. Wherein, it is stated that, the petitioner has paid the ACD amount as demanded in eight installments and that the security deposit is presently available is adequate as required. 5. Therefore, in view of the payment of ACD amount by the petitioner, no further orders are required to be passed in this writ petition. 6. Accordingly, writ petition is closed as infructuous. No costs. 4 7.
