Petitioner has filed the present writ petition seeking a direction to respondent No.1-Nagar Nigam, Almora to make payment of family pension and other retiral dues payable to her late husband Madan.

It is the case of the petitioner that her husband was working with the respondent No.1-Nagar Nigam Almora (then Nagar Palika Parishad, Almora) as Sweeper/Paryavaran Mitra, who died during service on
09.12.2001. The petitioner, being his wife, got compassionate appointment as Sweeper/Paryavaran Mitra with the respondent no.1. The petitioner contends that her husband has not been paid any benefit towards his untimely death like gratuity and other admissible

2026:UHC:7449 2 dues and further she has not been sanctioned family pension by the respondent no.1.

Learned counsel for respondent No.1-Nagar Nigam Almora submits that the petitioner has moved a representation to the respondent no.1 on 18.12.2024 (Annexure No.4 to the writ petition) claiming the aforesaid benefits, which is pending disposal. He further submits that if a direction is issued to the respondent No.1 to consider and take a decision on the said representation dated 18.12.2024 (Annexure No.4 to the writ petition), ends of justice would be met.

In view of the submission made by the learned counsel for the parties, this Court is inclined to decide the present writ petition finally.

Accordingly, the writ petition is finally disposed of, with a direction to respondent No.1-Nagar Nigam ALmora/ Municipal Commissioner, to take a decision on petitioner’s representation dated 18.12.2024 (Annexure No.4 to the writ petition) within a period of two months from the date of production of certified copy of this order, sympathetically or after examining all aspect of the matter in accordance with law.
