JUSTICE R.K. PATTANAIK Order No. ORDER 19.01.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Basudevpur P.S. Case No.457 of 2025 corresponding to G.R. Case No.730 of 2025 pending in the court of learned J.M.F.C., Basudevpur on the grounds stated. 3. Gone through the contents of the FIR as at Annexure-1 and the claim of deposits having been made by the petitioner as against the misappropriated amount alleged in the FIR. It is submitted to the Court that the petitioner was the Branch Post Master at the relevant point of time when the alleged misappropriation took place. The claim is that the petitioner deposited an amount of Rs.87,000/- on 6th November, 2023 and Rs.30,000/- on 8th November, 2023 voluntarily. The petitioner was in-charge of the Post Office by then and alleged to have committed criminal breach of trust with the allegation of misappropriation. Recording the objection of the State but from the FIR itself, the Court finds that there have been deposits made by the petitioner and the receipts of the deposits being at Annexure-2, considering the same and the fact that the investigation is concluded with filing of the chargesheet in the meantime as informed, this Court is inclined to grant her pre- arrest bail by the following order. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is directed that in the event, the petitioner is arrested, she shall be released on pre-arrest bail by the Arresting Officer upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount. 6.
