2. Dependents of deceased by name, Venkatesha and Varalakshamma are present.
3. Copy of demand draft, drawn in the name of Venkatesh and Varalakshmamma along with memo is filed. Same is taken on record.
4. Taking note of the same, the order of the learned Trial Magistrate in C.C.No.792/1999, confirmed in Criminal

Appeal No.17/2009 insofar as conviction of the accused for the offence punishable under Section 279 and 304A of Indian Penal Code is confirmed.
5. However, the sentence of imprisonment as ordered by the learned Trial Magistrate, confirmed by the First Appellate Court is modified by directing the petitioner to undergo simple imprisonment for the day till the raising of the Court, as additional fine amount of Rs.3,00,000/- which could be paid as compensation to the dependants of deceased, is already paid by the petitioner before this Court in the form of demand draft and the same is acknowledged in the order sheet.
6. Accordingly, criminal revision petition stands
disposed of.
