No.24357 of 2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India, to issue order or orders, direction or directions, writ, particularly one in the nature writ of Mandamus, or any appropriate writ, declaring the action of the respondents in with-holding the EMD, FSD, ASD amounts in respect of the work “47/4 KM road from MV Road to JP Road (via) Kapavaram Village of Pamarru Mandal even after completion / expiry of the defect liability / stipulated period and inspite of repeated requests, as illegal, arbitrary, discriminatory, unjust enrichment, violative of Articles 14,19, and 21 of the Constitution on India and consequently, direct the respondents to forthwith pay the aforesaid amounts of Rs. 6,52,401/- (Rupees six lakhs fifty-two thousand four hundred and one only), together with interest thereon @ 12% per annum from date of completion of defect liability period and to pass such other order as this Court deems fit and proper. 02. It is the contention of the petitioner that even though the respondents admit that the petitioner is entitled to the aforesaid amount, no payment has been made. The petitioner further contends that such non-payment of money is clearly arbitrary and high-handed, requiring interference of this Court. 03. On the other hand, learned Assistant Government Pleader for Gram Panchayat and Rural Development, while admitting about the claim of the petitioner, placed on record a copy of written instructions received from the Executive Engineer, PRI Division, Machilipatnam, dated 05.09.2026 vide Lr.RC. No.1 / H5 / Court cases / WP No.24357/2026, dated 05.09.2026, stating that bank guarantee bearing No.1835BG000123, dated 27.08.2018 for Rs.2,75,000/- was returned to the petitioner and remaining balance amount for Rs.3,93,697/- would be 3 BSB,J W.P. No.24357 of 2026 submitted to the Pay and Accounts Officer, Vijayawada for making payment to the petitioner. 04. The learned counsel for the petitioner requested to pass appropriate order for the payment of the amount admitted in the written instructions. 05. In view of the submissions made on both sides, the writ petition is disposed of, directing the respondents to pay an amount of Rs.3,93,697/- (three lakh ninety three thousand six hundred ninety seven rupees only) to the petitioner, along with the interest, if any, at the rate entitled, within a period of two (02) months from the date of receipt of a copy of this order. It is open to the petitioner to agitate the claim for higher rate of interest, if any, payable by the respondents, before an appropriate forum. There shall be no order as to costs.
