The petitioner is apprehending his arrest in connection with Hunterganj PS Case No.137 of 2023, for offence registered under section 341, 342, 323, 353, 504, 34 of the IPC, pending in court of learned Judicial Magistrate First Class, at Chatra.

Learned counsel for petitioner submits that the petitioner is Assistant Teacher (Para teacher) in Utkramit Vidyalay, Dumari, Hunterganj and at the relevant time of occurrence he was in his school for performing his duty and his implication in this case is not genuine and bonafide. He next submits that there is allegations of entering into the land, pertaining to which one encroachment case was going on. He also submits that the allegations are there against the 13 named accused persons and 10 to 15 unknown persons of altercation with the police personnel. He also submits that 12 accused persons have been granted anticipatory bail by the Coordinate Bench in ABA No.9535 of 2023.

4. Learned State counsel opposes prayer and submits that the allegations are there of being member of unlawful assembly.

Considering that 12 accused persons have been granted anticipatory bail in the aforesaid ABA and the petitioner is said to be Assistant Teacher and at the relevant time of occurrence he was in his school for performing his duty, and in the facts and circumstances of the present case, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned Judicial Magistrate First Class, at Chatra, in connection with Hunterganj PS Case No.137 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
