Today, the Executive Officer of the Municipality is personally present in Court with the records. The records as produced include the sanction building plan granted in favour of Sri Ranjit Chowdhury for construction at holding No. 27/2 Bhadhuri Para Lane, Nadia. From the above documents it appears that Ranjit Chowdhury had been given the sanction to construct on the aforesaid property by the municipal authorities vide permit dated 8th June, 2020. From the submissions of the parties it would also transpire that the construction had been completed long back, subsequently, however, a additional tin structure has been constructed by the side of the boundary wall by Ranjit Chowdhury which is having permanent base. 2 2. Learned advocate for the private respondent is represented and would submit that it is entirely a temporary structure and used for general purpose. 3. Having heard the learned advocates appearing for the respective parties and noting from the submissions made by the private respondent that the construction is temporary in nature, I am of the view that the municipal authority should test out the same. If such construction is only temporary, no consequential steps may be necessary, however, if the municipality find that the structure is permanent in nature, appropriate steps shall be taken in accordance with law within a period of six weeks from the date of communication of this order. 4. The records filed in Court are returned to the municipal authority. 5. The personal appearance of the Executive Officer, Harendranath Biswas, is dispensed with. 6. Private respondent shall be at liberty to take back the sanction plan submitted earlier against a photocopy of the plan which shall be retained in the record. 7. Accordingly, WPA 3398 of 2026 stands disposed of. (Raja BasuChowdhury, J)
