This writ petition was registered on the basis of newspaper report published in the daily newspaper “Dainik Jagran” dated 20.12.2025, wherein, it has been reported that there is an inter-state gang involved in human trafficking which is active in sale and purchase of newly born children. 2. Upon notice, the State of Bihar has appeared and filed counter affidavit, wherein, it has been stated that newborn child from Bhojpur District, Bihar was sold for Rupees four Lakh in Ramgarh, Jharkhand and upon notice from this Court, the Director, Social Welfare-cum- Vice Chairman, State Child Protection Society, Bihar, Patna, vide its letter no.163 dated 20.12.2025 had requested the District Magistrate, Bhojpur, Arah to take necessary action. In response thereto, the District Magistrate, Bhojpur had informed that the child had been 2026:JHHC:201-DB 2 recovered by the Station House Officer, Aglaon (Gadhani). 3. Upon investigation, it has been revealed that newborn child was bought and sold, had been successfully recovered and thereafter, handed over to the victim, Khushbu Devi (mother) and her husband, Chitranjan Kumar, residents of Narayanpur, District Bhojpur by the concerned Police Officer. 4. Lastly, it has also been mentioned that upon information received on 07.12.2025 in the morning from outside the Primary Health Centre, Agiaon, under the Narayanpur Police Station area, two women of Narayanpur village, 1. Krinta Devi, wife of Pankaj Rawani, 2. Kavita Sharma @ Kavita Devi, wife of Mahendra Sharma along with 3. Chandni Sharma and other associates, as per pre- planned scheme, sold the newborn baby of the victim Khushbu Devi, born in Agiaon hospital itself on 07.12.2025 at around 2:00 p.m. to Dr. Dilip for Rs.50,000/-. 5. After verification of the above information and necessary action for recovery of the child on 16.12.2025, on the basis of statement of the complainant Khusbhu Devi, an FIR was registered against 1. Krinta Devi, wife of Pankaj Rawani, 2. Kavita Sharma @ Kavita Devi, wife of Mahendra Sharma, both residents of Narayanpur Police Station, Bhojpur, 3. Chandni Sharma, 4. Dr. Dilip in Agiaon (G) Police Station being Case No.183/25 under Section 143(4)/61(2) of B.N.S and the investigation is now in progress. 6. In this view of the matter, we see no reason to keep this petition alive as it is not a case of inter-state gang involved in human 2026:JHHC:201-DB 3 trafficking. Moreover, the law has to take its own course. 7. Ordered accordingly. 8. Before parting with this order, it needs to be observed that this Court had come across the news item regarding two missing children from the Dhurwa area falling under the Dhurwa Police Station and this fact was brought to the notice of the learned State Counsel, who was asked to obtain instruction. 9. Mr. Piyush Chitresh, learned AC to AG for the respondent- State, on the basis of instruction, submits that the children have now been identified and have been seen with some strangers and for their recovery, Special Investigation Team has been constituted. 10. We hope and trust that the respondent-State would take follow- up action and ensure the recovery of the two missing children and restore to them to their respective parents. 11. Let the copy of this Court be communicated to the Secretary, Department of Home, Jail and Disaster Management, Govt. of Jharkhand as well as the Director General of Police, Jharkhand for necessary action and compliance.
