The petitioner herein is aggrieved by the fact that the transfer order dated 12.03.2026 (Annexure P-2), in terms whereof, the petitioner has been transferred from Directorate Food, Civil Supplies & Consumer Affairs, Shimla, H.P., to the Office of District Controller, Food Civil Supplies & Consumer 1Whether reporters of the local papers may be allowed to see the judgment?
2 2026:HHC:19988 Affairs, Lahual-Spiti at Keylong, District Lahaul-Spiti, H.P., is not being complied with, as the petitioner is not being relieved to join at Keylong.
3. Learned Additional Advocate General had handed over instructions dated 18.05.2026 and on the strength thereof, he submitted that because of the paucity of staff, the petitioner is not being relieved.
4. This Court is of the considered view that once the appropriate Authority has passed the transfer order, now the implementation thereof cannot be stalled on the ground that there is paucity of staff. All these factors should have been taken into consideration by the Authority when it passed the transfer order. After the passing of the transfer order, the Authority cannot become wise, more so, in light of the fact that till date, the transfer order has not been recalled.

Therefore, this petition is allowed and respondents are directed to relieve the petitioner forthwith after the Modal Code of Conduct, which is in vogue on account of the ensuing Panchayat Elections, is lifted, to enable him to join the new station i.e. Office of District Controller, Food Civil Supplies &
3 2026:HHC:19988 Consumer Affairs, Lahual-Spiti at Keylong, District Lahaul-Spiti, H.P. It is further ordered that the transfer order Annexure P-2 shall not be varied or recalled in the meantime. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
