PUBLIC PROSECUTOR The Court made the following: 2 ORDER: The Criminal Revision Case has been filed under Sections 438 and 442 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’) challenging the notice dated 28.08.2025 issued in M.C.No.97 of 2025 by the learned Mandal Executive Magistrate, North Sector, Machilipatnam, under Section 141(1)(b) of ‘the BNSS’ for forfeiture of bond for good behavior. 2. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The notice was allegedly issued on 01.09.2026, whereas the Petitioner was directed to appear before the Mandal Executive Magistrate on 03.09.2026 at 12.00 PM. 4. Mr.M.Solomon Raju, the learned counsel for the Petitioner, submits that the time granted was too short to enable the Petitioner to comply with the conditions or to furnish any explanation. 5. Having regard to the facts and circumstances of the case, the Criminal Revision Case is disposed of, modifying the notice dated 28.08.2025 issued in M.C.No.97 of 2025 by the learned Mandal Executive Magistrate, North Sector, Machilipatnam, only to the extent of the time granted for appearance. 6. Instead of the earlier direction requiring the Petitioner to appear on 03.09.2026 at 12.00 PM, the Petitioner is now directed to appear before the Mandal Executive Magistrate within one (01) week from the date of receipt of a copy of this order.
