JUSTICE PARTHA SARTHY ORAL ORDER 2 08-04-2026 Heard learned counsel for the parties. 2. The petitioner has preferred this application for grant of regular bail in connection with Kadirganj P.S. Case no.88 of 2023, registered under section 392 of the Indian Penal Code. 3. As per the prosecution case, the informant states that while he was going with his nephew, four unknown accused persons on the point of pistol snatched and looted their mobile phones. 4. Learned counsel for the petitioner submits that the F.I.R. was registered against unknown. Referring to the material that has transpired in course of investigation as would be evident from the order of the learned trial Court rejecting the application for bail of the petitioner it is submitted that the name of the petitioner transpired in the confessional statement of Patna High Court CR. MISC. No.23540 of 2026(2) dt.08-04-2026 2/2 co-accused Pintu Kumar, who has himself been enlarged on bail vide order passed in the learned Court below in B.P. no.82 of 2025. No incriminating article has been recovered from the petitioner’s possession who is in custody since 30.8.2025. The cause of false implication of the petitioner is his antecedents. 5. The application for bail is opposed by learned A.P.P. for the State. 6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the name of the petitioner transpiring in the confessional statement of co-accused who has himself been enlarged on bail, no incriminating article having been recovered from the petitioner’s possession and the petitioner having remained in custody for over 7 months since 30.8.2025, the petitioner is directed to be enlarged on bail in connection with Kadirganj P.S. Case no.88 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Masaurhi, Patna. avinash/- (Partha Sarthy, J) U T
