Heard learned counsel for the applicant as well as learned A.G.A. for the State. This application under Section 529 BNSS has been filed to direct the Additional Civil Judge (Junior Division)/ Judicial Magistrate, Court No.12, Mathura to decide the Case No. 1028 of 2024 (M/s Om Bhawan Nirman vs. Girdhari Rajput), under Section 138 of the Negotiable Instruments Act, Police Station Highway, District Mathrua, expeditiously within a stipulated period. Learned counsel for the applicant submits that the said case is pending since the year 2024 and as per Section 143 (3) of the N.I. Act it should be disposed of within a period of six months from the date of filing of the complaint but more than a year has been passed from the date of filing of the complaint, therefore, the same may be expedited within a stipulated time as fixed by this Court. In view of the provision of Section 143 (3) of the Negotiable Instruments Act, court below is expected to make all endeavours to decide the aforesaid complaint case expeditiously, preferably within a period of six months from the date of filing of certified copy of this order after giving opportunity of hearing to both the parties without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
