DICTATED BY SUJOY PAUL, CJ.:
1. Parties are represented through their respective learned counsels.
2. Heard.
3. Learned counsel for the petitioners submits that private respondents have raised construction over a land, which is mentioned as a “Nala” in the revenue record. The petitioners have already preferred representation to various authorities including Sub-Divisional Officer, Tamluk but, no action has been taken.
4. Parties agreed that if petitioners resubmit his representation in the name of Sub-
2 Divisional Officer alongwith a copy of this
order, the said authority may be directed to initiate appropriate proceedings and after hearing the private respondents, shall pass an order in accordance with law.
5. In view of consensus arrived at, this petition is
disposed of with the following directions:- (a) Petitioners may file a fresh comprehensive representation alongwith a server copy of this order before Sub- Divisional Officer, Tamluk. (b) The Sub-Divisional Officer, Tamluk, in turn, shall consider the representation of the petitioners within a period of 90 days from date and after hearing the affected parties including private respondents, he shall pass an order in accordance with law. (c) The outcome shall be communicated to the parties.

6. With the aforesaid and without expressing any opinion on merits, petition is disposed of.
7. Urgent photostat certified copy of this
order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
