1. The present writ petition has been filed for the following relief:-
“i. For a direction upon the respondent no.5, Circle Officer Pakur, to mutate the name of the petitioner for the land situated at mauza Pakur, Thana No.128, Jamabandi No.601, plot no.473 measuring 00B-04K- 00DHU under Pakur Block in the district of the Pakur. ii. For a further direction upon the respondent no.05 i.e. Circle Officer Pakur, to comply the order of respondent no.04 i.e. Land Reforms Deputy Collector, Pakur, passed in mutation appeal no.13/2025-2026 dated 10.07.2025, whereby and whereunder, the appeal is allowed and the Circle Officer Pakur, is directed to mutate the name of the petitioner within 30 days in the land-in-question and to enter the name of petitioner in register-II. iii. For a further direction upon the respondent no.5 Circle Officer Pakur, to pass the appropriate order in the application of the petitioner for mutation his name as per the order passed in appeal by the Land Reforms Deputy Collector, Pakur, in mutation appeal case no.13/2025- 26 dated
10.07.2025. iv. For a further direction upon the respondent no.05 to provide a detail copy of the order dated 14.10.2025 passed in mutation case no.6950R- 27/2024-25 Pakur, as from the online it appears there is rejection of the aforesaid mutation case. 2026:JHHC:1761

v. For a further direction upon the respondent no.05 to give details as under what circumstances repeatedly rejected the application of petitioner for mutation despite the order passed in mutation appeal no.13/2025-26 dated 10.07.2025 by the respondent no.04. vi.
For a further direction and order to set-aside and quash the order of Circle Officer Pakur, respondent no.05 dated 14.10.2025 passed in mutation case no.6950R27-2024-25.”
2. The concept of mutation is “Dakhil Khariz” that means firstly “Khariz” then “Dakhil”. A person whose name has to be Khariz is a necessary party but deliberately that person has not been made party in the present proceeding. 3. Further, it has not been disclosed in the petition that whether the seller of the impugned piece of land was holder of the mutation or not. 4. In that view of the matter, this Court finds no reason to entertain the present writ petition. 5. Accordingly, the present writ petition stands dismissed. 6. However, the petitioner is at liberty to work out his remedy in accordance with law. (Rajesh Kumar, J.)
