The learned counsel for the petitioner submits that the petitioner does not wish to press the prayers sought in this writ petition, but only seeks a direction for expeditious consideration of the application, to be filed for vacating the interim order. 3. The plaintiff has filed a suit for bare injunction. Along with the plaint, he has filed an application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure. The learned counsel appearing for the petitioner/ defendant submits that the petitioner/defendant will appear before the trial court and file an application for vacating the said order, and that a direction may be issued for its expeditious disposal in accordance with law. 5. In view of the above, this writ petition stands disposed of, permitting the petitioner/defendant to file an application for vacating the interim order under Order XXXIX Rule 4 of the CPC, with liberty to seek advancement of the matter. 6.
