1. Heard learned counsel for the respective parties.
2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Sadar P.S. Case No.520 of 2025 corresponding to G.R. Case No.1846 of 2025 pending in the court of learned J.M.F.C.(R), Berhampur on the grounds stated.
3. Perused the FIR as at Annexure-1. It is informed to the Court that the petitioner is having two other criminal cases which are not recent ones. It is further submitted that on the basis of the disclosure made by the co-accused persons nabbed the spot by the local police, the petitioner apprehends his implication in the case. Recorded the submission of learned counsel for the State. It is claimed that the accused persons in the two other cases are on bail as therein chargesheet has not been filed. Considering the above facts and submissions of
learned counsels for the respective parties and since the petitioner apprehends arrest in view of the revelation made by the two other accused persons caught at the spot, this Court, though not inclined to grant pre-arrest bail, is of the view that he should surrender before the learned court below for being released with stringent conditions.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is directed that in the event, the petitioner surrenders before the learned J.M.F.C.(R), Berhampur in connection with Sadar P.S. Case No.520 of 2025 corresponding to G.R. Case No.1846 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.40,000/-(rupees forty thousand) with one solvent surety for the like amount with such other conditions besides the following, such as, he shall co-operate the IO in the investigation and to attend the PS once in a fortnight for the purpose of investigation, till the same is over and also to furnish an undertaking before the court concerned not to involve himself in any such nefarious activities, while on bail.
6. Issue urgent certified copy of this order as per rules.
