By virtue of the present petition under Articles 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks the following reliefs: - “a) Issue an appropriate, direction, or order under Article 227 of the Constitution of India, read with the inherent powers under Section 528 of the BNSS, 2023, directing the Court of the Ld. JMFC (NI Act)-06, South-East, Saket, Delhi, to expedite and conclude the trial in CC NI ACT 2738/2023 and CC NI ACT 2739/2023 in a strict, day-to-day, and time- bound manner, preferably within a period of three (3) months; b) Impose exemplary costs upon the Respondents for their contumacious conduct and deliberate abuse of the judicial process, which has resulted in the wastage of precious judicial time; and c) Pass any further order(s) as this Hon’ble Court deems fit and proper in the interest of justice.” This is a digitally signed order. Learned counsel for petitioner, as per record, submits that though the proceedings were listed before the learned Trial Court on 08.11.2024, 24.05.2025, 16.10.2025, 07.11.2025 as also on 24.03.2026, and the NBWs were issued against respondent nos. 2 and 3 for the first time on 08.11.2024, as well as on 24.05.2025, after issuance of bailable warrants before that on 08.05.2024, the NBWs were stayed on 18.10.2025 and the parties were referred to the mediation. He submits that though the mediation proceedings inter se the parties failed, however, thence fresh NBWs were again issued, albeit, this time against respondent no.2 only. He submits that considering the aforesaid timelines, this petition is not proceeding before the learned Trial Court. 3. Without adverting to the facts on merits, considering the aforesaid timeline and also the nature of the pending proceedings, learned Trial Court is requested to make all efforts for disposing the CC NI ACT 2738/2023 and CC NI ACT 2739/2023 as expeditiously as possible, in accordance with law, however, taking into accord the daily listing as also the roster of the pending cases before it, preferably on or before 31.03.2027. 4.
