According to petitioner, she is legally wedded wife of late Anusuya Prasad, who served as Chief Assistant in GIC Peeda Dhanpur, District Rudraprayag and retired on 31.08.2013. Petitioner applied for family pension. Her claim has been turned down vide order dated 16.05.2026. Thus, feeling aggrieved, petitioner has approached this Court. 4. In the impugned communication dated 16.05.2026, Additional Director, Treasury, Pension and Entitlements, Uttarakhand has informed the Principal, GIC Peeda Dhanpur that for want of clarification on certain aspects, petitioner’s claim for family pension is rejected. 5. Learned counsel for petitioner submits that petitioner is the only wife of late Anusuya Prasad, even though late UKHC010137412026 2026:UHC:6883 Anusuya Prasad was having live-in relation with another lady, namely Sobti Devi, however, Sobti Devi, pre deceased Anusuya Prasad. Thus, it is contended that rejection of petitioner’s claim for family pension is without any reason or justification whatsoever. 6. Learned State Counsel, however, submits that Anusuya Prasad had indicated name of Sobti Devi as his nominee for pension. 7. Learned counsel for petitioner, however, submits that in the service book of late Anusuya Prasad, there is no mention of Sobti Devi. 8. Having regard to the facts and circumstances of the case, the writ petition is disposed of with liberty to petitioner to approach the Director, Treasury, Pension and Entitlements by making representation. In her representation, petitioner shall enclose all documents, which support her claim for family pension, including the Marriage Certificate. If petitioner makes such representation within three weeks from today, Director concerned shall take decision, as per law, within three months thereafter. It goes without saying that other persons, who are also stakeholders for pension and other dues of late Anusuya Prasad, shall also be heard by Director, before passing any order.
