Tiwari, Spl.P.P. ----- 03/ 16.01.2026 The petitioner is seeking regular bail, in connection with Gumla P.S. Case No. 365 of 2025, registered for the offence under Sections 69, 79 and 352(2) of Bharatiya Nyaya Sanhita, 2023 and Section 67 of the IT Act, pending in the court of learned Chief Judicial Magistrate, Gumla. 2. Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner by a major lady, who is a widow. He next submits that the first relationship was established with the informant in the year 2018, which has been continued till the date of filing of the FIR. He then submits that although this petitioner has already married with another lady and in spite of knowing this fact, the lady has continued the relationship with this petitioner. He further submits that the informant has refused for the medical check-up and that fact has come in para-22 of the case diary, which has been mentioned in the impugned order. He also submits that the petitioner is in judicial custody since 06.11.2025. 3. Learned Spl.P.P. appearing for the State has opposed the prayer and submits that the petitioner was also found in relationship [ 2026:JHHC:1151] -2- with another lady and the that lady is a witness in the present case. He further submits that the allegation of threating is also there against this petitioner. 4. Looking into the contents of the FIR, it transpires that the informant was in relationship with the petitioner and the first relationship was established in the year 2018, which has continued till the date of filing of the FIR and said FIR has been filed on 05.11.2025. It is also disclosed in the FIR itself that even after knowing the fact that the petitioner was already married with another lady, they have continued the relationship and further the petitioner is in custody since 06.11.2025. 5. In the attending facts and circumstances of the case, I am inclined to release the petitioner, on regular bail. 6. Accordingly, the petitioner, named above, is directed to be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gumla, in connection with Gumla P.S.
