ORDER The petitioners apprehend arrest for the alleged offence under Sections 296(b), 115(2), 118(1), 351(2) and 74 of the Bharatiya Nyaya Sanhita, 2023, in Crime No.317 of 2025 on the file of the respondent police seeks anticipatory bail. https://www.mhc.tn.gov.in/judis
CRL OP No. 6131 of 2026 __________ Page2 of 6 2.The case of the prosecution is that when the defacto complainant questioned the petitioners who were trying to pluck coconuts from the land belonging to her, the petitioners threatened and assaulted the de facto complainant using a knife, due to which the de facto complainant sustained injuries and was admitted in a Hospital. Hence, the case.
3. The learned counsel appearing for the petitioners submitted that the injury sustained by the de facto complainant is simple in nature. He further submitted that a counter case in Crime No.318 of 2025 is pending against the de facto complainant. Apart from that a civil litigation is also pending in respect of the land in which coconut trees are standing. He further submits that though the occurrence took place on 26.07.2025, however, the First Information Report has been registered with a delay on 03.08.2025. The petitioners are ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police fairly submits that the injuries sustained by the de facto complainant is simple in nature and that she has already been discharged from the hospital. https://www.mhc.tn.gov.in/judis

5. I have given anxious consideration to the submissions made by the
learned counsel on either side and also perused the records available. 6. The entire issue revolves around plucking coconuts in the tree standing in the land belonging to the de facto complainant. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the injured has been discharged from the Hospital and also considering the fact that there is civil litigation pending in respect of the subject property, this Court is inclined to enlarge the petitioners on anticipatory bail, subject to certain conditions. 7. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned Judicial Magistrate No.II, Tirupattur, on condition that the petitioners shall execute a bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties each, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: (a) If the petitioners fail to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled; (b) The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form https://www.mhc.tn.gov.in/judis

The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity; (c) the petitioners shall report before the respondent police everyday at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation; (d) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560]; (e) If the petitioners thereafter absconds, a fresh FIR can be registered under Section 269 of BNS Act.
