1. Petitioner has filed this petition seeking following reliefs:
“10.1 That, this Hon’ble Court may kindly be pleased to issue direction to the respondent authorities to complete the selection recruitment process for the post of Sub- Engineer (Civil) under reservation of Ex- Indian Army (Ex-servicemen) category according to circular/policy dated 23.07.2016, 04.06.2007 and 19.01.2026 issued by the Administration department State of Chhattisgarh, in the interest of justice. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent authority to get benefit of reservation of Ex- Indian Army (Ex-servicemen) to the petitioner for selection and appointment on the post of Sub Engineer (Civil) in the interest of justice. 10.3 Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.”

Learned counsel for petitioner submits that petitioner has submitted an application for appointment on the post of Sub-Engineer pursuant to the notification issued by the respondent authorities.
3 / 4 Petitioner is an Ex-servicemen. According to his instruction, respondent authorities are issuing notices to other applicants (Ex-servicemen) who participated in recruitment proceedings but are is State Govt. employement, and are still working. He submits that according to circular issued by State Government, the benefit of giving priority/reservation to the Ex-servicemen is only a one time measure, if the Ex-Servicemen has already submitted an application for recruitment proceedings and got appointment on the said post under Ex-servicemen quota he, could not be given further benefit under Ex- servicemen quota . Petitioner has submitted representation before the respondent authorities on 10.02.2026 which till date is pending
consideration and, therefore, direction be issued to respondent authorities to consider and take decision on pending representation before the respondent authorities.

Learned counsel for the State submits that in view of limited prayer made by learned counsel for petitioner, he is having no objection.
4. I have heard learned counsel for the parties and also perused the documents annexed along with writ petition.
5. On due consideration of the submission made by learned counsel for the respective parties, this writ petition at this stage is
disposed of permitting petitioner to submit fresh representation before the respondent authorities and if such representation is submitted, respondent authorities shall consider and decide the same in accordance with law, expeditiously, preferably within a further period of 02 months from the date of receipt of the Order.

6. It is also directed that if petitioner submit fresh representation along with the copy of the already submitted representation, concerned respondent authorities shall consider the fresh representation along with pending representation.
