The writ petitioner has been filed, inter alia, complaining interference with the petitioner’s right of egress and ingress by way of construction of a structure “Mukta Mancha” on public road in front of the petitioner’s property situated at Mouza – Ranaghat, J.L. No. 155, LR Khatian No. 40106, Dag Nos. 7505, 7506 admeasuring about 2.5 katha being holding No. 16 at Ward No. 7 of Ranaghat Municipality, District – Nadia. 2. Having heard learned advocates appearing for the respective parties and noting that the representation/complaint has already been made by the petitioner addressed to the Chairman, Ranaghat Municipality dated 26th February, 2026, which is annexed at page 32 of the writ petition, I am of the view that the Municipality should decide on the petitioner’s representation by giving an 2 opportunity of hearing to the petitioner and by passing a reasoned order. It is expected that the decision in this regard must be taken by the municipality on an expeditiously basis. Since, at this stage Mr. Banerjee, learned advocate representing the Municipality would submit that some more time should be given, I am of the view that the decision must be taken within a period of 12 weeks from the date of communication of this order. Pending decision by the Municipal authorities, no construction shall be carried out by the Municipality. 3. It is made clear that this Court has not gone into the merits of the case made out by the petitioner herein and it shall be open to the municipality to decide the same uninfluenced by any of the observations made herein. 4. Since no affidavit has been called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents. 5. Accordingly, WPA 6362 of 2026 stands disposed of.
