2. By means of the present Transfer application under Section 447 of BNSS, 2023, the applicant has sought transfer of the proceedings of Misc. Criminal Case No.97 of 2026 under Section 144 BNSS, 2023, ‘Smt. Sonia Negi vs. Shri Gaurav Negi, pending before Principal Family, Dehradun to the Family Judge, Pauri, District Pauri Garhwal,

The ground on which transfer has been sought is that the applicant/husband is a resident of village Chwincha, Tehsil Pauri, District Pauri Garhwal and he submits that the respondent has shown a fake address at Dehradun, whereas her permanent mayka is at Srinagar and it would be convenience of the both the parties that the matter be
transferred from Dehradun to Pauri Garhwal.
4. A bare perusal of paragraph no.12 of the transfer application would reveal that the applicant has himself stated the main cause for filing of this transfer petition is that the petitioner is posted at Bengaluru.
5. It is also admitted by the learned counsel for the applicant that the applicant can appear before the Principal Judge, Family Court, where the proceedings under Section 144 of the BNSS are presently pending through video conferencing.

In such view of the matter, where the applicant is admittedly posted at Bengaluru and is praying for the transfer of the case from Dehradun to Pauri Garhwal, it does not appear to be reasonable as to why such a transfer should be allowed. Moreover, when there is facility of joining the proceedings through video conferencing, there is no rhyme or reason to allow the said transfer application.
7. In view of the aforesaid, the transfer application is rejected. However, it is made clear that the Principal Judge, Family Court shall allow the applicant to appear through VC on the dates fixed as per rules.
