1. Heard Mr. Anchal Kumar Matre, learned counsel for the petitioners. Also heard Mr. Priyank Rathi, learned Government Advocate for respondents / State.
2. The petitioners have filed this petition praying for following relief:-
“It is therefore most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the
order dated 24.01.2026 passed by the Learned First Additional Sessions Judge, Kunkuri, District-
3 Jashpur (C.G.), the order dated 19.09.2025 passed by the Learned JMFC, Kunkuri, Dist.- Jashpur (C.G) framing charges against the petitioners along with charges framed as well as the entire chargesheet pursuant to FIR no. 32/2024 dated 28.02.2024 registered at Police Station Kunkuri, District- Jashpur (C.G.) for the offences punishable under Sections 153A, 153B, 295A, 505(2), 109, 294 read with Section 34 IPC and quash the entire criminal proceedings against the petitioners in Cr.Cs.No. 1472/2025 pending before JMFC, Kunkuri, Dist. Jashpur (C.G.) and pass such other order as this Hon'ble Court may deem fit and proper in the interest of justice.”
3. The present petition has been reported to be suffering from various defaults / defects pointed out by the Registry as under: a). District name completely not mentioned in the Petition No.8 b). certified copy of Annexure P/2 not filed as prayed in the petition. c). Page Nos. 26 to 27 properly not arranged in main petition as well as Page No.166 d). Petitioner No.9 not signed on Vakalatnama. e). Pages Nos. 48 and 49 both bottom portion are incomplete.
4. It further appears that though the petition was filed on 25.03.2026, but the learned counsel for the petitioner has not taken care to
4 remove the said defaults and has drafted a vague and sketchy petition, in a casual manner and has wasted the precious time of the Court.
5. In view of the same, learned counsel for the petitioner prays to withdraw the present petitioner with liberty to file afresh.
6. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh appropriately curing the defaults, subject to depositing a sum of Rs.2,000/- as cost in the Registry of this Court and the same shall be transmitted to the Government Children’s Home for Orthopedically Handicapped, Mana Camp Raipur (C.G.) for wasting the precious time of the Court.
