The instant petition is preferred under section 528 of BNSS, 2023, by the applicants ‘Rahul Singh’ S/o Sri Puran Singh, ‘Neeraj Singh’ S/o Sri Ram Singh, ‘Bharat Singh Negi S/o Sri Ranjeet Singh, along with the affidavits of the applicants and the respondent no. 3, the complainant/victim, whereby, they are praying for quashing of the entire proceeding of Criminal Case No. 47 of 2026 titled as State vs. Rahul Singh and Others initiated pursuant to Case Crime No. 0003 of 2026 P.S. Chaukhutia, District Almora, wherein, all the applicants have been summoned to face the trial for the offences punishable under sections 115(2), 351(2), 352(3) and 352 of BNS, 2023. 5. All the applicants and the respondent no. 3 are present in court and are identified by their respective counsel. 6. It is contended in the compounding application that the parties have now settled their dispute amicably and they all are friends and belongs to the same district and resolved their dispute amicably and they have no grudges against each other and, therefore, the proceeding be closed. 7. It is further submitted that all the offences UKHC010148142026 2026:UHC:7526 are compoundable. 8. On the other side, learned A.G.A. also submits that all the offences are compoundable, therefore, taking into consideration the nature of allegations the proceedings can be closed. 9. After hearing the submission of learned counsel for the parties and taking into consideration that the parties have settled their dispute amicably and all the offences are compoundable, this court is of the view that there is no useful purpose to continue this proceeding. 10. Accordingly, the compounding application as well as the instant criminal miscellaneous application are allowed and the entire proceeding of Criminal Case No. 47 of 2026 titled as State vs. Rahul Singh and Others initiated pursuant to Case Crime No. 0003 of 2026 P.S.
