P.P. …...... 03/18.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 302/34 of the Indian Penal Code and Sections 27 of the Arms Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. This is a case of murder. 5. Admittedly, nothing has been recovered from the possession of the petitioner. It is only on the basis of confessional statement of the co-accused, the petitioner has been made an accused in this case. Even the motorcycle of the deceased was not recovered from the possession of the petitioner, rather it was recovered from the possession of another co-accused, who disclosed that it is this petitioner who had handed over the same to him to conceal the same. Except this there are no material against the petitioner, even there are no eye witness to the occurrence also nor it is a case of last seen. 6. Considering the aforesaid submission, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Sessions Judge-II, Gumla in connection with Session Trial No.250 of 2024, arising out of Bishunpur P.S. Case No.21 of 2023 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his own name within the State of Jharkhand.
