This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 33/2025 registered at Police Station – Korandha, District – Balrampur- Ramanujganj (C.G.) for the offence punishable under Section 108 of BNS.
2. Case of the prosecution, in brief, is that father of the deceased lodged merg intimation and stated that on 08.10.2025 the deceased Radha returned home after watching Karma festival. A quarrel taken between deceased and the applicant regarding her alleged consumption of liquor. During the altercation, the accused pulled her hair and slapped her twice, causing her to fall on the bed, after which he went to sleep. 2 younger brother of deceased, informed that Radha had committed suicide by hanging herself from a tree with a rope. Upon completion of investigation, the applicant was arrested. Hence, this application.

Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the applicant happens to be the real brother of the deceased and it is sated that some minor quarrel taken place between the brother and sister regarding the deceased consuming the liquor at Karma festival, because of which the applicant slapped her, on account of which she committed suicide. It is submitted that the applicant is in jail since 13.10.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail.
4. On the other hand, learned State counsel, opposes the bail application and submits that. It is submitted that as per the postmortem report of the deceased, it is apparent that there is no symptoms of consumption of alcohol in the body of the deceased, whereas, the deceased had also suffered some injuries on her person, and it appears that on account of assaults made by the applicant on the deceased, she committed suicide by hanging. As such, the bail application deserves to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.
6. Taking into consideration the facts and circumstances of the case and also the fact that as per the postmortem report of the deceased,
3 it is apparent that there is no symptoms of consumption of alcohol in the body of the deceased, whereas, the deceased had also suffered some injuries on her person, and it appears that on account of assaults made by the applicant on the deceased, she committed suicide by hanging, thus, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
7. Accordingly, this bail application of applicant – Vikas Kerketta involved in Crime No. 33/2025 registered at Police Station – Korandha, District – Balrampur-Ramanujganj (C.G.) for the offence punishable under Section 108 of BNS, is rejected at this stage.
8. Needless to say that the trial Court concerned is at liberty to proceed with the trial and conclude the same, expeditiously.
