Petitioner has prayed for cancellation of bail of the opposite party no.2 on the assurance of providing job. The accused allured and cheated to the tune of Rs.57,34,001/-. Learned Magistrate on 27.11.2024 granted bail to the accused person on a completely different premise without assessing the merits of the case. Learned advocate appearing for the State has produced the case diary. I have considered the materials which have been collected by the investigating officer including the charge- sheet. I am of the opinion on assessment of the materials which have been collected by the investigating agency that a case for further detention of the opposite party no.2 at this stage is unwarranted. The investigation is not to the satisfaction of this Court. Accordingly, the petitioner, if so advised, will prefer an application for further investigation before the 2 jurisdictional court which may be decided in accordance with law. In view of the observations made above, no interference is called for so far as the order granting bail is concerned. If there are change of circumstances, it would be the discretion of the learned Magistrate to independently consider whether any custodial detention of the opposite party no.2 is warranted. Report submitted by the learned advocate appearing for the State be kept with the record. With the aforesaid observations, the application for cancellation of bail being CRM (R) 95 of 2025 is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
