The Petitioner has filed this CRLMC with a prayer to quash the order dated 07.07.2025 passed by the learned J.M.F.C.(LR), Bhubaneswar in 1.C.C. Case No. 644 of 2021 wherein NBW has been issued against the present petitioner. 3. Learned counsel for the Petitioner submits that the aforesaid case is pending before the learned S.D.J.M, Bhubaneswar and, subsequently, in the year 2022, the case record has been transferred to the Court of learned J.M.F.C.-III, Bhubaneswar. After transfer of the case, the counsel appearing for the accused/petitioner was unable to locate the case record. III, Bhubaneswar to the Court of Ld. J.M.F.C. (LR & LTV). On 02.12.2024 and 03.02.2025 the counsel appearing for the accused person/petitioner was present before the learned J.M.F.C. (LR & LTV) but again the file could not be traced. Non-taking of steps was not intentional but only the reason as stated above. The counsel appearing for the accused person was unable to trace/locate the case record for which the cross-examination of the complainant has been declined and discharged for which the counsel appearing for the accused failed to touch the material aspect of the case. 4. Considering the above submission and the grounds taken in this CRLMC, the order dated 07.07.2025 passed by the learned J.M.F.C.(LR), Bhubaneswar in 1.C.C. Case No. 644 of 2021 is quashed. However, the Petitioner is directed to appear before the court below as and when the matter is listed. 5. The CRLMC is, accordingly, disposed of.
