Upon coming of the instant petition for consideration the counsel for the petitioner would submit that the petitioner a contractor during the course of participation in tender notice issued by respondents on 19.12.2025, the tender document of the petitioner came to be rejected on the premise that petitioner has been black listed resulting into the allotment of work covered in the said tender notice in favour of other tenderer, however, subsequent thereto, respondents addressed a communication to the petitioner on 29.01.2026 stating therein that rejection of the tender document of the petitioner on the ground that black listing had happed erroneously due to typographical error and that since the said black listing have had happed as per the respondents erroneously on account of typographical error, as such, the instant petition has been rendered infructuous. However, counsel for the petitioner would contend that since the petitioner has been deprived by the respondents from lawful participation in the tender in question on unfounded and baseless premise, grave prejudice has been caused to the petitioner for which the petitioner reserves a right to claim of damages from the respondents. 2. Be that as it may, since the petition has been rendered infructuous as observed above no further proceedings are required to be undertaken however, the petitioner shall be at liberty to seek appropriate reliefs in regard to above against the respondents in appropriate proceedings, if permissible under law.
