1. Mr. Nishant Krishna Adhikari, learned counsel for the applicant through V.C.
2. By the instant petition preferred under Section 528 of BNSS 2023, the present applicant Suman Ahlawat, W/o Narendra Ahlawat is praying for expeditious disposal of proceeding of Complaint Case No. 250 of 2026, Suman Ahlawat vs. Mona, initiated under Section 138 of Negotiable Instruments Act 1881, pending in the court of learned Judicial Magistrate, II, Dehradun.
3. It is contended by the learned counsel for the applicant that aforesaid complaint case has been instituted on 07.01.2026 and despite sufficient service the respondent is deliberately delaying the proceeding by seeking adjournment.
4. The relief, as sought, for expeditious disposal of the complaint case, as above, appears to be innocuous.
5. In such view of the matter and keeping in view that mandate of Section 143 of the Negotiable Instruments Act, the instant C528 applicant is disposed of finally with the direction to the learned Judicial Magistrate, IInd , Dehradun to expedite the proceedings of Complaint Case No. Complaint Case No. 250 of 2026, Suman Ahlawat vs. Mona, as

2026:UHC:7274 early as possible preferably within nine months from the date of production of certified copy of this order.

It is made clear that the learned Trial Court should keep in mind the mandate of Section 143 of Negotiable Instruments Act while expediting the trial within aforesaid period, since, the present applicant is facing acute financial crisis since her husband is not serving and is not medically fit, therefore, this aspect may also be looked into by the Trial Court in order to expedite the proceeding of abovementioned complaint case.
