Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction more particularly in the nature of Writ of Mandamus declaring the action of the Respondents in not considering the application made by the petitioner under PGRS on 22-12- 2025 vide token No.242, in the light of the reports submitted by the 5th Respondent to the 2nd Respondent vide Roc..A/146/2014 dated 26-02-2015 and Roc..A/146/2014 dated 4- 07-2015, with regard to the allotment of agricultural land to an extent of Ac. 1-04 Cts in Sy.No.255/3, which is in the possession and enjoyment of the petitioner, in Gajulapelluru Village, BN Kandriga Mandal, Tirupati District, in lieu of the land acquired by the respondents for the purpose of Teluguganga Canal and approach road in Sy.No.250/2 from the land assigned to the petitioner under Ex-servicemen quota No.56/4/1405 dated 25-7-1995, as arbitrary, illegal, for extraneous considerations and in violation of Article 14,21 and 300A of the Constitution of India, and consequently direct the Respondents to consider the application made by the petitioner under PGRS on 22- 12-2025 vide token No.242 in the light of the reports submitted by the 5th Respondent to the 2nd Respondent vide Roc..A/146/2014 dated 26-02-2015 and Roc.A/146/2014 dated 4-07- 2015 and take appropriate decision for allotment of land to an extent of Ac.

Heard Sri Subba Rao Korrapati, learned counsel for the petitioner and Sri Divya Theja, learned Assistant Government Pleader for Revenue, for the respondents. 2. The petitioner-Ex-Serviceman filed the above writ petition to declare the inaction of respondent No.2 in considering the representation, dated 22.12.2025-Ex.P7, for allotment of land to an extent of Ac.1-04 cents in survey No.255/3, in Gajulapelluru village, BN Kandriga Mandal, Tirupati, in lieu of the acquisition of land in Survey No.250/2, assigned to the petitioner under Ex- Servicemen quota vide DKT Patta No.56/4/1405 dated 25.07.1995-Ex.P1, for Telugu Ganga Canal and approach road, as illegal and arbitrary. 3.
Learned counsel for the petitioner would submit that the then respondent No.5 assigned an extent of Ac.5-00 cents in Survey No.250/2- Ex.P1. Thereafter, the petitioner’s name was updated in the Record of Rights (RoR), and Pattadar Pass Book-Ex.P2 was issued to the petitioner. Later the petitioner’s wife purchased Ac.5-00 cents in survey Nos.250/4, 253/2 and 254/2 and the petitioner purchased Ac.5-00 cents in Survey Nos.250/3 and 251/1, which are adjacent to the petitioner’s land, under registered document Nos.57 of 2010 dated 21.10.2010-Ex.P3 and 134 of 2011 dated 02.02.2011- Ex.P4, respectively. While the matter stood thus, the respondents, without acquiring the land and paying compensation/exgratia, took away the
petitioner’s land of an extent of Ac.1-04 cents in Survey Nos.250 and 251 and constructed the Telugu Ganga Canal and laid an approach road. Learned counsel would submit that the petitioner made several representations, the last being Ex.P7, on which the Collector directed respondent No.5-Tahsildar to examine and submit a report. However, no action was taken either by respondent No.5 or by respondent No.2.
4. Learned Assistant Government Pleader, on instructions, would submit that respondent No.5 has to verify old records of assigned lands. He would submit that respondent No.5 will examine the records and submit a report to respondent No.2. He would submit that the road has already been laid in part of the petitioner’s land.
5. Given the above facts and circumstances of the case, this writ petition is
disposed of at the admission stage with the consent of the learned counsel on either side, directing learned respondents 2 and 5 to consider the representation-Ex.P7, made by the petitioner and pass appropriate orders strictly in accordance with law, as expeditiously as possible, preferably within three months from the receipt of a copy of this order. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
