The present writ petition has been filed for following reliefs:- (i.) For issuance of appropriate writ(s), order(s), direction (s), specifically a writ in the nature of mandamus commanding upon the Respondent authorities, particularly Respondents no. 3 & 5, to immediately and forthwith release/remove the land of the petitioner’ vendor from prohibited list/pratibandhit suchi and further issue up to date rent receipt in favour of petitioner’ vendor after accepting cess and rent appertaining to land situated at Mauza Pundag, Khata No. 383, Plot No. 462 measuring an area of 5.00 Acre, which has been stopped by Respondent No. 5 without any rhyme and reason, admittedly the petitioner’ vendor having peaceful possession, right, title, interest over the land in question by constructing boundary wall & residential house. (ii.) For issuance of appropriate writ(s), order(s), direction (s), specifically a writ in the nature of certiorari for quashing of the list (Annexure-8) obtained through RTI to the extent at Sl.62118 whereby and whereunder the lands of the petitioner's vendor has been declared as Gair Mazrua and accordingly has been put under prohibited list/pratibandhit suchi as a consequence to which no sale or registration 2026:JHHC:648 2 W.P.(C) No.4088 of 2024 of land appertaining to land situated at Mauza Pundag, Khata No. 383, Plot No. 462 measuring an area of 5 Acre can take place.” 2. The description of land is as follow:- The land situated at Mouza-Pundag, Khewat No.2, Thana No.228, Plot No.462, under Khata No.383, measuring an area of 5 acres. 3. The action of the State is based upon the notification No. 1132 dated 26.08.2015, which is on the basis of Section 22-A of the Registration Act, 1908. The Section 22-A of the Registration Act, 1908 has already been declared ultra vires by the Division Bench of this Court vide order dated 01.05.2025, passed in W.P.(C) No. 5088 of 2018 and analogous cases. 4. Since, it has been declared ultra vires, hence, the notification No. 1132 dated 26.08.2015 also does not exist and as such there is no concept of prohibited list now. 5. So far as the prayer with regard to the creation of mutation or transfer of mutation is concerned, it can be changed only by resolving dispute through the process of civil court. There is no power with revenue authority vis-à-vis cancellation of mutation. 6. In that view of the matter, so far as second prayer is concerned, it is hereby, declared that any change will be made by the Circle Officer as per the outcome of the civil court order between the parties. 7.
