The petitioner is apprehending his arrest in connection with Herhanj P.S. Case No.46 of 2024, for offence registered under section 17 and 18 of NDPS Act, pending in court of learned Special Judge, NDPS, Latehar. 3. Learned counsel for the petitioner submits that false allegations are made of cultivation of opium plant on the forest land. He next submits that the land is not belonging to the petitioner and the petitioner is having no criminal antecedent as disclosed in paragraph no.18 of the petition. He also submits that three co-accused persons have been granted anticipatory bail in ABA No.3051 of 2025 and one co-accused has been granted anticipatory bail in ABA No.727 of 2026 and on these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned State counsel opposes prayer and submits that 2026:JHHC:9259 2 allegations are there of cultivation of opium plant on the forest land. 5. Considering that the land is not belonging to the petitioner and the petitioner is having no criminal antecedent as aforesaid and the co-accused persons have been granted anticipatory bail in the aforesaid ABAs, and in this view of the matter, the petitioner, above named, is directed to surrender before learned court within two weeks from today and learned court shall release petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
