Lalita Chauhan & Others --Petitioners Versus Smt. Premvati & Another --Respondents Hon’ble Manoj Kumar Tiwari, J. Mr. Aditya Singh, Advocate, for the petitioners. (2) Petitioners are defendants in a suit for permanent prohibitory injunction. Plaintiff to the said suit moved an application under Order 6 Rule 17 CPC, seeking leave to amend the plaint. Application filed by the plaintiff was rejected by the Trial Court, however Revisional Court allowed the revision, filed by the plaintiff, and granted leave to amend the plaint. Thus feeling aggrieved by the order passed by the Revisional Court on 19.9.2016, petitioners have approached this Court. (3) As per the communication received from 1st Additional Civil Judge (Sr. Div.), Haridwar, Original Suit No. 249 of 2010, Smt. Premvati v. Natthu Ram, was decided on 31.8.2024. (4) Since the suit itself has been decided, therefore, challenge to the order passed by the Revisional Court, whereby leave to amend the plaint was granted, do not survive. Accordingly, writ petition is dismissed as infructuous.
