By means of present writ petition, petitioners have sought the indulgence of this Court for a direction to the respondents to grant benefit of selection pay/time scale to the petitioners by counting the services rendered by the petitioners before the institution came under grant- in-aid.

Brief facts of the case are that the petitioner no.1 is presently working as a Lecturer (Economics) and petitioner no.2 is working as a Lecturer (English) in a grant-in-aid institution since 26.07.2015. The institution was brought under grant-in-aid on 04.01.2017. The petitioners claimed selection grade by counting the service rendered by them prior to the institution was brought under grant-in-aid w.e.f. 04.01.2017. The claim of the petitioners for selection grade is pending with the respondents department.

Learned counsel for the petitioners submits that the matter of petitioners in the present writ petition is covered by the judgment rendered by the Coordinate Bench of this Court in WPSS No.1955 of 2015, Munendra Singh Rana and others Vs. State of

2026:UHC:6905 2 Uttarakhand and others and other connected writ petitions decided on 27.03.2017, which was upheld by the Division Bench of this Court by the judgment and
order dated 30.08.2018 passed in SPA No.279 of 2018, State vs. Harish Singh Bora and others, and batch.

This fact has also been admitted by the learned counsel for the State.

In this view of this matter, the present writ petition stands allowed, in terms of the judgment and
order passed by the Coordinate Bench of this Court in WPSS No.1955 of 2015, Munendra Singh Rana and others Vs. State of Uttarakhand and others and other connected petitions decided together on 27.03.2017, upheld by the Division Bench of this Court vide judgment and order dated 30.08.2018 passed in SPA No.279 of 2018, State vs. Harish Singh Bora and others and batch.

Accordingly, petitioners are permitted to make a representation and claim selection grade from the competent authority within a period of two weeks from today and if such representation is made by the petitioner to the competent authority of the department within two weeks, the said representation shall be decided by the competent authority in the light of the
judgment and order passed by Coordinate Bench of this Court in WPSS No. No.1955 of 2015, Munendra Singh Rana and others Vs. State of Uttarakhand and others and SPA No.279 of 2018, State vs. Harish Singh Bora and others and batch of special appeals, within a period of two months thereafter.
