The petitioner is apprehending his arrest in connection with Siyaljori P.S. Case No.75 of 2025 for the alleged offences registered under Sections 305(e) and 317(2) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate 1st Class, Bokaro. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be an employee of Electro Steel Limited and on the date of incident the petitioner was doing his duty from 10:30 AM to 5:30 PM in the Electro Steel Plant. He further submits that the house of the petitioner is located near the place of occurrence and in view of that the name of the petitioner may have come in the CCTV footage. He then submits that the petitioner has received the notice under Section 35(3) of Bharatiya Nagarik 2026:JHHC:727 --2-- A.B.A. No. 56 of 2026 Suraksha Sanhita, 2023 and has submitted his reply before the Investigating Officer and given an undertaking that he will cooperate in the investigation by way of Annexure-2. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioner of theft of 15 meters of copper wire. 5. Annexure-2 is a document which clearly suggests that the petitioner has complied the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
