Learned counsel appearing on behalf of the petitioner submits that although the petitioner has not been named in the FIR as an accused, the police are looking for him. Learned counsel appearing on behalf of the State submits that there is no accused by the name of Abhijit Das, son of Kartik Das, as would be evident from a plain reading of the First Information Report and the other materials available in the case diary. Therefore, the application for anticipatory bail is misconceived. In view of the fact that the petitioner has not been made an accused in this case, the application for anticipatory bail is disposed of as infructuous. However, this order shall not preclude the petitioner to file an application for anticipatory bail afresh, in the event the petitioner is added/mentioned as an accused in this case.
