Kausik CRM (NDPS) 713 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Muchipara Police Station Case No. 30 dated 06.03.2024 under Section 21(c)/29 of the NDPS Act, 1985. And In the matter of : Sunil Prasad Yadav ……Petitioner. Mr. Tirtharaj Roy Mr. Uday Sankar Chattopadhyay Mr. Arijit Bera ……for the Petitioner. Mr. Subhomoy Bhattacharya Mr. Dattatreya Dutta ……for the State. The subject matter of the case relates to recover of 2147 bottles of Phensedyl. Petitioner was arrested on or about 06.03.2024 and since then he is in custody. Charges have been framed on 07.02.2025 and till date not even a single witness has been examined. The earlier order dated 19.11.2025 reflects there was direction to complete the prosecution witnesses within 3 months from the next date fixed. There has been huge recovery of contraband in the present case. As such one more opportunity is granted to the prosecution to only complete the seizure list witnesses within a period of 60 days. If after examination of the seizure list witnesses the learned Trial 2 Court is of the opinion that the case has been diluted, in that case, the learned Trial court on an application filed by the petitioner will consider the same leniently in favour of the accused. With the aforesaid observations CRM (NDPS) 713 of 2026 is disposed of. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
