ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus directing the respondent to consider the representation of the petitioner dated 24.12.2025 and to pay all the retirement benefits including gratuity, P.F. Leave wages, etc., with interest at the rate of 10% for the late payment of gratuity amount and 12% interest for other legal dues.
2. The case of the petitioner is that the petitioner joined the services of the respondent Corporation on 21.05.1993 and retired from service on 30.06.2023 as Special Grade Driver at Anna Nagar Deport, Chennai. Despite his retirement, the respondent has failed to pay terminal benefits till date without any reason. Although the petitioner has made continuous representations requesting the settlement of the retirement benefits, the respondent has not yet settled the dues. The petitioner submits that that the respondent is legally obligated to pay the gratuity amount within 30 days from the date of retirement; failing this, the petitioner is entitled to interest on the delayed payment. Due to this delay, the petitioner is unable to meet personal obligations, including his daughter’s marriage. The petitioner has also made a representation on 24.12.2025 to the respondent, but, the same has not been considered till date. 3. Heard the learned counsel appearing for the petitioner and the Standing Counsel appearing for the respondents.
4. Considering the facts and circumstances of the case and the
submissions made on either side, this Court directs the respondent Corporation to consider the petitioner’s representation dated 24.12.2025 and the terminal benefits shall be disbursed to the petitioner within a period of four (4) weeks from the date of receipt of a copy of this order.
